1800mattress "Create Our Next Commercial" Contest
OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER OR WIN CONTEST.

DATES OF CONTEST: The 1800mattress "Create our Next Commercial" Contest (the "Contest") begins at 12:00 a.m. Eastern Time ("ET") on July 31, 2010 and ends at 11:59 p.m. (ET) on November 1, 2010 (the "Contest Period").

ELIGIBILITY: In order to be eligible for entry into the Contest, must be a legal resident of the 48 Contiguous US including the District of Columbia and 18 years or older at the time of entry with a unique valid Social Security number at the time of entry (the "Entrant"). Employees and their immediate family members (parents, children, siblings or spouse, regardless of where they live, or persons living in same household, whether related or not) of 1800mattress (the "Sponsor"), their parent companies, contractors, subsidiaries, distributors, sales representatives, retailers, advertising and promotion agencies, The National Sweepstakes Company (the "Contest Administrator")and any others, herein (the "Contest Entities") engaged in the development, production, execution or distribution of this Contest are not eligible to participate. Void in Puerto Rico and where ever else restricted or prohibited by law.

OVERVIEW/PARTICIPATION: Entrants need to produce a 60 second commercial that is 1800mattress theme branded showcasing how 1800mattress enhances a good night sleep and takes your night sleep to the next level. Sponsor encourages Entrants to think unconventionally and from an "outside-of-the-box" perspective. Commercial should be relevant to the Sponsor's industry and be able to market/advertise the Sponsor in an innovative way to its demographic. Commercial may be implemented and produced by the Sponsor and be used as a promotion tool by the Sponsor. Each Entrant will be reviewed and scored based upon the judging criteria in the Judging section below. Entrants must provide the specific advertisement requirements. The Entrant who has the highest cumulative score based on the judging criteria will be deemed the Grand Prize winner.

HOW TO ENTER: Visit www.1800MattressContest.com (the "Website") during the Contest Period and complete and submit the required steps (collectively, the "Submission") to enter the Contest:

  1. Contest Entry Form: Fill out the Official Contest Entry Form in its entirety, including your first and last name, email address, physical address, phone number, and date of birth. Then complete the Video/Commercial section.
  2. Video/Commercial: Complete the video upload section on the Website to include: 1. the video name (Limit of 75 characters), 2. the video description (Limit of 300 characters), and 3. the video/commercial (Limit of 60 seconds or less). The commercial should showcase how 1800mattress enhances a good night sleep and takes your night sleep to the next level. Sponsor encourages Entrants to think unconventionally and from an "outside-of-the-box" perspective. Commercial should be relevant to the Sponsor's industry and be able to market/advertise the Sponsor in an innovative way to its demographic. The commercial should contain the 1800mattress logo at least two (2) times within the 60 seconds. Video submissions should be no longer than 60 seconds in length, no larger than 300 MB and will only be accepted in .avi, .flv, .mpeg, .m4v, .mp4, and .wmv, .mov format(s). An extension that has been changed from one format to another will be rejected on the Website and will not be eligible. The video must be 16:9 aspect ratio without black borders and a minimum resolution of 720 x 486.
  3. Then click the submit button on the Website in order for the online Submission to be eligible for entry into the Contest. All Online Submissions must be submitted by 11:59 pm ET on November 1, 2010 in order to be eligible.

All Entrants consent to the use of his/her/its name, likeness, biographical information, and voice in advertising and/or promotional activities worldwide without additional compensation.

If any of the individuals pictured in the videos submitted are minors in their state of residence, the Entrant represents and warrants that he/she has obtained the consent of each minor's parent or legal guardian to videotape the minor and that such parent or legal guardian agreed that the Sponsor and its agents can use, exploit, and distribute in any media whatsoever, including without limitation the Internet, now known or hereafter created, worldwide in perpetuity, such minor's name, likeness, image, voice and comments without any further consent or compensation.

Limit of 3 entries per Entrant for the entire Contest. Uploading your video to another website or social media site or submitting to any other competition will void your entry. Any attempt by any Entrant to enter more than three (3) Submission by using multiple/different addresses, identities, logins and/or any other methods will void all of that Entrant's Submissions, and that Entrant will be disqualified from the Contest. Late Submissions will not be accepted. Sponsors are not responsible for lost, late, mutilated, incomplete Submissions. All Submissions shall become the exclusive property of the Sponsors and will not be returned. Sponsors have no obligation to acknowledge receipt of or to return any Submissions received. Submissions that; (a) are determined by the Sponsors and/or the judges in their sole discretion to be indecent, offensive, inappropriate or morally objectionable, (b) illegal or are otherwise unfit for publication to the Website; or (d) violate these Official Contest rules will not be eligible.

By submitting an Entry Form and other required submission materials, the Entrant: (i) warrants and represents that he/she has read these Official Contest Rules, is eligible to participate in the Contest and agrees to be bound thereby; (ii) warrants and represents that all of the information provided in his/her submission materials is accurate, (iii) warrants and represents that the submission materials are the original work of the Entrant and do not violate any third party's legal rights (including without limitation rights of copyright, trademark or other intellectual property right, privacy and/or publicity), and/or any applicable law; (iv) represents and warrants that the submission materials do not contain any disabling device, virus, worm, back door or other disruptive or malicious code that may or are intended to impair their intended performance or otherwise permit unauthorized access to, hamper, delete or damage any computer system, software, network or data; (v) consents to the use of his/her name and/or likeness by the Sponsor and its respective authorized representatives for promotional purposes in connection with the Contest (whether online, in print or through any other media now known or hereafter developed), without additional compensation and unless prohibited by law; (vi) agrees that, if selected as the winner, Entrant will be solely responsible for any and all resulting tax consequences; and (vii) consents to allow Sponsor to use any information contained in the submission materials for the purpose of providing participant with information about available products or services in accordance with applicable law.

JUDGING/WINNING: Winners will be determined based on the two (2) phases of the judging process below:

PHASE 1: On or about November 1, 2010 all eligible Submissions will be judged by a qualified, independent panel of judges. Eligible Submissions will be judged based on the following criteria:

  • Creativity of how 1800mattress gives you a great night sleep (40%)
  • Originality in effectively meeting the theme of 1800mattress (30%)
  • Brand Communication of 1800mattress (30%)

The ten (10) Submissions who have the highest score will proceed to Phase 2 of the judging process (the "Finalists"). In the event of a tie in Phase 1, the Submissions involved will be judged by one (1) judge who will serve as a tiebreaker. The tied Submission with the highest score will proceed to Phase 2.

PHASE 2: In Phase 2, the top ten (10) Finalists' Submissions from Phase 1 will be evaluated by the judges.

On or about November 15, 2010 all eligible Submissions will be judged by a qualified, independent panel of judges. Eligible Submissions will be judged based on the following criteria:

  • Creativity of how 1800mattress gives you a great night sleep (40%)
  • Originality in effectively meeting the theme of 1800mattress (30%)
  • Brand Communication of 1800mattress (30%)

In the event of a tie in Phase 2, the Submissions involved will be re-judged by an additional judge who will serve as a tiebreaker and evaluate such tied Submissions according to the criteria listed in Phase 1. No telephone calls or correspondence will be accepted regarding public vote or judges' selections.

Grand Prize winner will be notified by email or mail on or about 14-days after Phase 2 is complete.

In addition, Sponsor may, in its sole and absolute discretion, elect to promote and advertise any submission materials from participants. Sponsor or Contest Entities are not responsible for the appearance or streaming quality of videos online. All judging of eligible Submissions will be under the supervision of a qualified panel of judges, whose decisions are final in all matters relating to the Contest.

PRIZES:

GRAND PRIZE: One (1) Grand Prize of $5,000 to be awarded in the form of a check.

The maximum total ARV of Grand Prize to be awarded is $5,000. Limit one (1) prize per person/household.

SECOND PRIZE: Nine (9) Second Prizes of SNAPP Mini Camcorder. Limit one (1) prize per person/household.

PRIZE CONDITIONS: Prizes are not transferable and no cash redemption or substitution allowed, except at Sponsor's sole discretion. Winners are solely responsible for all matters that may become due in respect to the Prize, including, but not limited to, all applicable federal, state and local taxes.

PRIZE CLAIM: Except where prohibited, potential Grand Prize winner must sign and return within seven (7) days of being notified, an affidavit of eligibility/liability/publicity release and W-9 form (the "Paperwork") in order to claim prize. If potential Grand Prize winner cannot be contacted within 48 hours from the date of the first attempt to contact him/her or if he/she fails to sign and return the Paperwork within the required time period, potential Grand Prize winner forfeits their right to the Grand Prize and an alternate Entrant will be selected based upon the Entrant having the next highest score from among all eligible Submissions received. Grand Prize winner consents to use of his/her name, likeness, biographical information, and voice in advertising worldwide without additional compensation (TN residents will not be required to sign a publicity release as a condition of winning a prize).

GENERAL RULES OF PARTICIPATION: This Contest is subject to all applicable federal, state and local laws. By participating, Entrants and their participating entities agree to be bound by these Official Rules and the decisions of the Sponsors and waive any right to claim ambiguity in the Contest or these Official Rules. Sponsors are not responsible for lost, late, misdirected, undeliverable or incomplete Submissions, whether due to system errors or failures, faulty transmissions or other telecommunications malfunctions, Submissions not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise. Sponsors may prohibit an Entrant (or their parent or legal guardian if Entrant is not the age of majority in his/her state of residence) from participating in the Contest or winning a prize if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other Entrants, Sponsors, or Contest Entities. If for any reason this Contest is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsors which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, then Sponsors reserve the right at their sole discretion to cancel, terminate, modify or suspend the Contest and judge from those Submissions received up to the cancellation/suspension date. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY'S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

NO LIABILITY: By participating, Entrants agree to release, discharge, indemnify and hold harmless the Sponsors, Contest Entities and each of their respective officers, directors, employees, representatives and agents from and against any claims made by winners, Entrants, or any other third parties, related in any way to the operation of this Contest as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Contest-related activity or participation in this Contest.

WINNER'S LIST. For a list of the winners, please send a self-addressed, stamped, business size (#10) envelope to: "Create Our Next Commercial" Contest Winner List PO Box ADDRESS. Requests must be received by November 30, 2010.
